Custer County men accused of abduction, brutal assault

September 14, 2011

Two Broken Bow men appeared in Custer County District Court Sept. 8 for arraignment. Each is charged with three felony counts stemming from a June 25 incident involving the brutal assault of another Broken Bow man in his apartment.
Geoffrey J. Eng, 24, and Lewis J. Dominguez, 19, both of Broken Bow, have each been charged with false imprisonment, making terroristic threats and 1st degree assault.
The two are accused of breaking into the apartment of Zachary McAlevy and assaulting him while he was sleeping in his bed. According to the arrest warrants, Eng and Dominguez allegedly broke out the window leading up to McAlevy’s apartment and went inside, where they then reportedly punched McAlevy numerous times while in his bed.
The affidavit goes on to say that Eng and Dominguez allegedly then dragged McAlevy out of his bed and kicked and stomped him numerous times. Eng reportedly told a third party and former roommate of McAlevy that the pair kicked and stomped McAlevy because their hands were tired of punching him.
Eng and Dominguez reported kept McAlevy in his apartment all the next day, fearful that if he went to work his co-workers might ask questions and the two men would get in trouble.
First degree false imprisonment is a Class IIIA felony and carries a possible penalty of 0-5 years imprisonment and/or $10,000 fine. Terroristic threats is a Class IV felony, punishable by up to five years in prison and/or $10,000 fine, and 1st degree assault is a Class II felony, which carries a penalty of 1-50 years in prison.
Both Eng and Dominguez plead not guilty to all charges. Eng remains in custody in the Custer County Jail on $15,000 bond, while Dominguez had his bond reduced to $1,000 PR bond due to his ties to the community and the fact that he had a place to stay if released.
Jury trial for both men was set for Oct. 11 at 9 a.m., with a pretrail hearing set for Sept. 22 at 9:30 a.m.
