Prior offender arraigned for sexual assault

Travis Marcus, 30, appeared in Custer County District Court April 3 for arraignment on two counts. Marcus is charged in count 1 with criminal attempt - 2nd degree sexual assault of a child, and count 2, child abuse.
The charges stem from an incident that took place in January 2014, less than one month after Marcus was released from the Nebraska Department of Corrections on similar charges. He had been sentenced in Custer County District Court in December 2013, to 1 1/2 - 2 years in prison after being found guilty of 1st degree sexual assault of a child, and was released after serving less than one month in Lincoln.
The charges he now faces carry the following possible penalties: count 1, Class III felony, 1-20 years in prison and/or $25,000 fine; count 2, Class I misdemeanor, 0-1 years in prison and/or $1,000 fine.
Marcus entered a plea of not guilty to both charges. His case was set for jury trial June 9, with a pretrial conference set for May 22. He remains in custody in the Custer County Jail on 10 percent of $350,000 bond.
