Six arraigned in District Court |

Six individuals were arraigned in Custer County District Court Dec. 3 on felony charges ranging from bad checks to sexual assault. One of the cases appearing for arraignment before District Judge Karin Noakes involves alleged sexual assault of a child. Brian J. Maring, 35 of Eddyville, is charged with sexual assault of a child. The charge stems from incidents that allegedly took place during the summer of 2003, with a minor age 14 or younger. The Class IIIA felony carries a possible penalty of 0-5 years imprisonment and/or a $10,000 fine. Maring entered a plea of not guilty to the charge. The case was set for jury trial Feb. 8, 2010, with a pre-trial hearing set for Jan. 21, 2010. His bond was continued.
Delaune V. Singing Goose, Sr., age 56 of Broken Bow, has been charged with two separate counts; count 1 - third degree assault of a police officer, a Class IIIA felony, and count 2 - terroristic threats, a Class IV felony. The charges stem from an Aug. 31, 2009 incident in Custer County. Singing Goose plead not guilty to both charges. The case was set for jury trial Feb. 8, 2010, with a pre-trial conference scheduled for Jan. 21, 2010. Bond was continued. James L. Kracht, Sr., 66 of Elm Creek, was arraigned on a charge of issuing bad checks, aggregated. Kracht is accused of writing insufficient fund checks between July 30 and Sept. 28, 2008, totaling $1,500 or more. The Class III felony carries a possible penalty of 1-20 years imprisonment, and/or a $20,000 fine if convicted. Kracht plead not guilty to the charge. The case was set for trial by jury Feb. 8, 2010, with pre-trial conference set for Jan. 21, 2010. His bond remains at $5,000 with a 10 percent privilege. Kyle McLaughlin, age 54 of Broken Bow, is charged with two separate counts; count 1 - Driving Under the Influence (DUI) 4th offense, and count 2 - Driving Under Suspension (DUS). Count 1, a Class IIIA felony, carries a possible penalty of 0-5 years incarceration and/or %10,000 fine. Count 2, a Class IV felony, carries a possible penalty of 0-5 years, $10,000 fine and 15-year license revocation. Sentences on the two charges, which stem from an alleged June 30, 2009 incident, could also be ordered to be served consecutively. McLaughlin entered a plea of not guilty to both counts, and the case was set for jury trial Feb. 8, 2010, with pre-trial conference Jan. 21, 2010. His bond was continued. Allen J. Foos, 45, was also arraigned on two charges. Count 1 alleges that on or about July 25, 2009, Foos committed theft of property valued at more than $1,500. Theft is a Class III felony. Count 2 alleges that between May and June 2009, Foos committed theft by deception, also a Class III felony. Foos plead not guilty on both counts, and the case was set for jury trial Feb. 8, 2010. Pre-trial conference was scheduled for Jan. 21, 2010, and bond was continued. Also arraigned Dec. 3 was 46-year-old Dale F. Mackley of Kearney. Mackley is charged with Driving Under Suspension, a Class IV felony. He plead not guilty to the charge, and the case was set for jury trial Feb. 8, 2010. Pre-trial conference was set for Jan. 21, 2010, and bond was continued. Amber Milleson, age 31 of Hickman, was scheduled for sentencing on a charge of issuing bad checks. Milleson did not appear, and Judge Noakes issued a bench warrant with bond set in the amount of $5,000. Russell D. VanHouten, 46 of Gothenburg, was also scheduled for sentencing Dec. 3. VanHouten appeared in District Court Nov. 5, at which time he plead no contest to one count of felony DUS. The plea was entered as part of an agreement with the state. At the Dec. 3 hearing, VanHouten’s attorney, Mike Borders, requested a continuance so his client could complete an alcohol evaluation. Judge Noakes granted the request and the case was continued to Jan. 21, 2010. His bond was also continued. In a previous case, Patricia R. Button, 46 of Sargent, appeared for sentencing in District Court Nov. 19. Button was charged with theft of services after renting a vehicle from Kershner Auto in Broken Bow and failing to return the car. Judge Noakes sentenced Button to two years probation on the Class IV felony, and ordered her to pay restitution in the amount of $7,194.47. Button was also ordered to write a letter of apology to the victim within 30 days. |
